These Terms of Service (“Terms”) govern your access to and use of the Tipsy Land progressive web app (“App”), including any content, functionality, and services offered through the App. By accessing or using Tipsy Land, you (“User” or “you”) agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using Tipsy Land, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use Tipsy Land.

2. Age Restriction and Eligibility

Tipsy Land is intended for adults of legal drinking age in their respective jurisdiction. You must be at least the legal drinking age in your country, state, or region to use Tipsy Land. By using Tipsy Land, you represent and warrant that you meet this age requirement.

We strongly discourage individuals under the legal drinking age from using Tipsy Land. We rely on your honest representation of your age.

3. Responsible Drinking and Disclaimer

Tipsy Land is designed to be a fun and social adult drinking game. However, we are committed to promoting responsible drinking. Alcohol is not a requirement and can be replaced with any type of non-alcoholic beverage.

You acknowledge and agree that:

• Alcohol Consumption is Voluntary and Your Own Responsibility: Your participation in any drinking activities suggested by Tipsy Land is entirely voluntary. You are solely responsible for your alcohol consumption and its consequences.
• Know Your Limits: Drink responsibly and within your personal limits. Never feel pressured to drink more than you are comfortable with.
• Never Drink and Drive or Operate Machinery: Under no circumstances should you drink and drive or operate machinery while using Tipsy Land or after participating in any drinking activities associated with it.
• Be Aware of Alcohol’s Effects: Understand the effects of alcohol and be mindful of your own tolerance.
• Take Breaks and Stay Hydrated: Take breaks between drinks and ensure you stay hydrated by drinking water.
• Know the Legal Drinking Age in Your Jurisdiction: You are solely responsible for knowing and complying with the legal drinking age and alcohol consumption laws in your location.

Tipsy Land and its developers are not responsible for your alcohol consumption or any consequences arising from it, including but not limited to:

• Health issues: Alcohol poisoning, illness, or any other health problems related to alcohol consumption.
• Accidents and injuries: Accidents, injuries, or damages to property occurring while playing or as a result of alcohol consumption.
• Social or personal consequences: Relationship problems, job loss, legal issues, or any other negative social or personal consequences.
• Dependence or addiction: Development of alcohol dependence or addiction.

If you have concerns about your drinking habits, please seek professional help. Resources are available to assist you with responsible alcohol consumption and addiction recovery.

4. Use of Tipsy Land

License to Use: Subject to these Terms, Tipsy Land grants you a limited, non-exclusive, revocable, and non-transferable license to access and use the App for your personal, non-commercial entertainment purposes.

User Conduct: You agree to use Tipsy Land in a responsible, lawful, and ethical manner. You must not:

• Use Tipsy Land for any illegal or unauthorized purpose.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Attempt to gain unauthorized access to any portion or feature of Tipsy Land, or any other systems or networks connected to Tipsy Land.
• Interfere with or disrupt the operation of Tipsy Land or the servers or networks connected to Tipsy Land.
• Use any automated means (e.g., bots, scrapers) to access or collect data from Tipsy Land without our express written permission.
• Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.
• Violate any applicable laws or regulations.
• Use Tipsy Land in a way that could negatively impact the App’s performance or availability.
• Encourage or promote irresponsible drinking or underage drinking through the App.

5. Subscription and In-App Purchases

• Subscription Access: Access to Tipsy Land App is offered on a monthly subscription basis. New users are typically offered an initial three (3)-day free trial period.
• Monthly Subscription: After the free trial period (if applicable), continued access to Tipsy Land requires a valid monthly subscription. Subscription fees and billing cycles will be as displayed within the App at the time of purchase.
• Subscription Cancellation: You may cancel your monthly subscription at any time through the App’s subscription settings. Cancellation will be effective at the end of your current billing cycle. No refunds will be provided for partial subscription periods.
• In-App Purchases: Tipsy Land may offer optional in-app purchases for additional features, content, or virtual items. These in-app purchases are non-refundable and are subject to these terms and conditions.
• Changes to Subscription Fees: We reserve the right to change our subscription fees at any time upon reasonable notice. Price changes will apply to your next billing cycle following notice.

6. Intellectual Property

• Tipsy Land Content: All content on Tipsy Land, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the design, selection and arrangement thereof (“Tipsy Land Content”), is owned by or licensed to Tipsy Land and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
• Limited License to Tipsy Land Content: We grant you a limited, revocable license to access and use Tipsy Land Content for your personal, non-commercial use solely in connection with your use of the App. You may not copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, or sell any Tipsy Land Content without our prior written consent.
• Trademarks: “Tipsy Land” and all related logos and designs are trademarks of Tipsy Land. You may not use these trademarks without our prior written permission.

7. Modifications to Tipsy Land and Terms

We reserve the right to modify, suspend, or discontinue Tipsy Land, or any part thereof, at any time without notice. We may also modify these Terms at any time by posting the revised Terms on Tipsy Land. Your continued use of Tipsy Land after the posting of revised Terms constitutes your acceptance of such changes. It is your responsibility to check these Terms periodically for changes.

8. Termination

We may terminate your access to and use of Tipsy Land, at our sole discretion, at any time, with or without cause, and with or without notice. Upon termination, your right to use Tipsy Land will immediately cease.

9. Disclaimer of Warranties

TIPSY LAND IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• TIPSY LAND WILL BE UNINTERRUPTED OR ERROR-FREE.
• THE CONTENT OR INFORMATION AVAILABLE THROUGH TIPSY LAND WILL BE ACCURATE, COMPLETE, OR RELIABLE.
• TIPSY LAND WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

YOUR USE OF TIPSY LAND IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TIPSY LAND, ITS DEVELOPERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE TIPSY LAND.
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON TIPSY LAND.
• ANY CONTENT OBTAINED FROM TIPSY LAND.
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
• THE SUGGESTION OR ENCOURAGEMENT OF ALCOHOL CONSUMPTION THROUGH TIPSY LAND.
• YOUR ACTUAL ALCOHOL CONSUMPTION WHILE USING TIPSY LAND.
• ANY CONSEQUENCES ARISING FROM YOUR ALCOHOL CONSUMPTION, WHETHER RELATED TO TIPSY LAND OR NOT.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tipsy Land, its developers, affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

• Your use of Tipsy Land.
• Your violation of these Terms.
• Your alcohol consumption and any consequences arising therefrom, whether related to Tipsy Land or not.
• Your violation of any rights of another party.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Delaware, United States of America, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or Tipsy Land shall be exclusively resolved in the state or federal courts located in Dover, Delaware, United States of America.

13. Entire Agreement

These Terms constitute the entire agreement between you and Tipsy Land relating to your use of the App and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Tipsy Land with respect to the App.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

By using Tipsy Land, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
